By placing an order though our website, you warrant that: (a) You are legally capable of entering into binding contracts; (b) You are at least 18 years old;
After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatch. The contract between us will only be formed when we send you the Dispatch Confirmation.
If an item is not in stock we will either telephone or email you within 48 hours to let you know. You will have the choice to either re-order a different Product, wait until new stocks arrive or cancel the order entirely, no questions asked. Please allow up to 28 days for new deliveries to arrive and then despatched.
If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds policy. (See refunds)
To cancel a Contract, you must inform us in writing and return the Product(s) to us immediately, in the same condition in which you received them, and at your own cost and risk.
The cost to dispatch the original order is not refundable.
The price of any Products will be quoted on our site from time to time, except in cases of obvious error.
Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our website may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge you the lower amount when dispatching the Product to you. If a Product's correct price is higher than the price stated on our website, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.
We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.
Payment for all Products must be by cheque, credit or card. We accept payment with Visa / Mastercard / Switch / Maestro / Solo and Visa Delta payment cards.
For international orders all credit card transactions will be in British Pounds Sterling. Those buying from abroad must note that we cannot be held responsible for the exchange rate used by your credit card issuer.
Cheques should be made payable to Ethical Babe Ltd., and home address details, cheque guarantee card number, expiry date and issue number (switch / maestro) on the back. Please add a telephone number in case we need to get in contact with you, and allow five working days for the cheque to clear before the order is fulfilled.
The current charges to the following destinations are listed below:
Standard Postage & Packing to UK Mainland is £3.95 for up to 2 KG. Orders over 2 KG are £4.95. The Standard delivery time is between 3-5 working days, but please allow for up to seven working days for products to arrive.
For Express Delivery the cost is £6.95. Orders must be placed before 11am for next working day delivery (UK mainland only). Outside mainland UK please allow upto 48 hours for delivery.
Orders placed after 11am will be sent the next working day.
All Express Delivery orders must be signed for and two delivery attempts will be made by the courier to obtain signatures. After these two attempts to deliver your order will be returned back to Ethical Babe.
No refunds will be given for failed delivery, and any further redeliveries will incur the relevant P&P costs.
**For remote destinations and islands, and for Next Day Special Delivery you will incur a surcharge. However, before any product(s) is dispatched you will be contacted to confirm the total postage cost, at which point you will be able to cancel the order if you wish to.
Please contact us for postage prices if any order weighs over 2kg, as costing is determined by weight. A maximum size restriction of parcel can also affect the postage price, but we will advise you of this if necessary.
Please allow for up to 14 days for delivery.
We will accept any unused, unworn and unwashed items back within 28 days of the date you received the item, whatever the reason. When you return a Product to us we will examine the returned Product and will notify you of your refund via email within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we received your cancellation or the day we confirmed to you via email that you were entitle to a refund for delivery of the defective Product.
Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.
Products returned by you within the seven-day cooling off period will be refunded in full, excluding the postage, and you will be responsible for the cost of returning the item to us.
When returning goods we cannot accept responsibility for parcels lost in transit, so please either insure all returns for the full value of the contents, obtain a 'Proof of Postage Certificate' from your Post Office, or use registered post to ensure safe delivery.
We warrant to you that any Product purchased from us through our website is of satisfactory quality.
Our liability in connection with any Product purchased through our website is strictly limited to the purchase price of that Product.
This does not include or limit in any way our liability: (a) For death or personal injury caused by our negligence; (b) For fraud or fraudulent misrepresentation; or (c) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
If you order Products from our website for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control. (Force Majeure Event) (a) Strikes, lock-outs or other industrial action (b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attach, war (whether declared or nor) or threat or preparation for war. (c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster. (d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. (e) Impossibility of the use of public or private telecommunications networks. (f) The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
We use the Protx payment system which uses a combination of established and innovative techniques to ensure the security and integrity of all sensitive data. Their internet facing web services are certified by Verisign, this ensures that no third parties can impersonate Protx to obtain secure information.
The transfer of the less sensitive transaction details from the retailer's site to Protx is encrypted and digitally-signed. This ensures that the information passed is secure and tamper proof.
Any communication between the customer and Protx is encrypted to the maximum strength supported by the customer's browser. The customer is also protected from fraudulent use of their card in a 'card not present' environment by their card issuer.
All data stored on Protx systems is held on encrypted and highly secured databases. Protx are regularly audited by Visa and Mastercard to ensure that their systems conform to the latest security standards.
